Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Property Appraiser Pro (the "Service"). It is incorporated by reference into the Terms of Service. Violations may result in warning, temporary suspension, permanent termination of access, and referral to law enforcement. Termination for violation is not subject to refund.

1. Who This Applies To

This AUP applies to everyone who accesses or uses the Service, including authorized users within a firm workspace, third-party integrators, and security researchers.

2. Professional Eligibility and Licensing

  • You must hold an active, valid state real estate appraiser license or certification in good standing to use appraisal preparation features.
  • You may not share account credentials with unlicensed individuals or allow unlicensed individuals to prepare appraisals under your credentials.
  • You may not use the Service to prepare appraisals for appraisers who did not personally perform the required inspection or analysis. The Service is not a ghostwriting tool.

3. Prohibited Uses — Appraisal Integrity

You may not use the Service to:

  • Create, store, or transmit appraisal content you know or reasonably should know to be fraudulent, falsified, or materially misleading.
  • Generate, submit, or deliver appraisal reports with falsified borrower, property, or transaction information.
  • Impersonate another licensed appraiser, firm, or individual.
  • Target, encourage, or produce a predetermined or desired appraised value. The Service may not be configured, used, or represented as a tool for achieving any specific valuation outcome.
  • Engage in conduct that violates the Appraiser Independence Requirements (AIR) established by Fannie Mae (Selling Guide B4-1.1-02), Freddie Mac, FHA, or VA.
  • Violate the Uniform Standards of Professional Appraisal Practice (USPAP) or any state appraisal licensing law.

4. Prohibited Uses — AI and System Integrity

You may not:

  • Use AI-generated narratives, comp scoring, or adjustment suggestions without independent professional review and verification as required by Section 6 of the Terms of Service.
  • Attempt to extract training data, model weights, system prompts, or other proprietary information from any AI component of the Service.
  • Use prompt injection techniques, jailbreaking methods, or other approaches intended to circumvent the Service's AI safety controls.
  • Submit inputs designed to cause the AI to produce harmful, illegal, or policy-violating outputs, or to disclose information about the underlying model.
  • Attempt to poison the training data or operational integrity of any Company system or third-party service (including the Claude API) through the Service.
  • Represent AI-generated outputs as the personal professional work product of any appraiser who has not independently reviewed, verified, and adopted that output.

5. Prohibited Uses — Infrastructure and Security

You may not:

  • Transmit malware, viruses, or any code designed to interfere with or damage any computer system.
  • Attempt to gain unauthorized access to the Service, other user accounts, or underlying infrastructure, including through brute force, credential stuffing, session hijacking, or exploitation of discovered vulnerabilities outside a responsible disclosure process.
  • Reverse engineer, decompile, or disassemble any part of the Service, except to the extent such restriction is prohibited by applicable law.
  • Circumvent, disable, or otherwise interfere with security-related features of the Service, including rate limits, authentication, access controls, or audit logging.
  • Impose an unreasonable or disproportionately large load on our infrastructure.

6. Prohibited Uses — Data and Content

You may not:

  • Upload or store content that infringes any intellectual property, privacy, or publicity right.
  • Upload Multiple Listing Service (MLS) data, photographs, or third-party content without the rights, licenses, or permissions required by your MLS subscriber agreement, applicable copyright law, and the content owner.
  • Scrape, bulk-download, crawl, or systematically extract data from the Service via automated means, except through documented APIs and within their rate limits.
  • Use the Service to store data unrelated to appraisal workfiles or your appraisal business operations.
  • Use the Service to send spam, unsolicited marketing, or any communication prohibited by the CAN-SPAM Act, TCPA, or similar laws.

7. Prohibited Uses — Commercial Conduct

You may not:

  • Resell, sublicense, white-label, or otherwise commercially redistribute the Service or its outputs without a separate written agreement with Company.
  • Use the Service to build a competing product or to benchmark for the purpose of competitive analysis.
  • Create multiple accounts to evade rate limits, subscription tier restrictions, or any terms of the Agreement.
  • Misrepresent the Service's capabilities, endorsements, or compliance posture to any third party.

8. Rate Limits and Fair Use

The Service enforces technical rate limits to protect performance and availability. Attempting to circumvent these limits — including by using multiple accounts, distributed requests, or automated tooling — constitutes a violation of this AUP and may result in immediate suspension.

9. Security Research and Responsible Disclosure

We welcome good-faith security research. Testing conducted in accordance with our Security Policy's responsible disclosure guidelines will not be treated as a violation of this AUP. This safe harbor does not extend to:

  • Denial-of-service attacks or sustained load testing.
  • Social engineering of our personnel, vendors, or customers.
  • Testing that degrades service for other users.
  • Accessing, modifying, or exfiltrating data belonging to other users.
  • Public disclosure before we have had a reasonable opportunity to respond.

10. Consequences of Violation

Violations may result in: warning; immediate removal of violating content; temporary suspension of access; permanent termination of the account; revocation of API keys; referral to law enforcement or licensing authorities; and/or civil action to recover damages and enforcement costs.

Termination for violation of this AUP is not subject to refund. We may preserve and disclose account data in connection with investigation of a suspected violation, in response to lawful legal process, or to protect the rights of Company or third parties.

11. Reporting Violations

To report suspected violations of this AUP, contact support@propertyappraiserpro.com with as much detail as you are comfortable providing. Security vulnerabilities should be reported separately to security@propertyappraiserpro.com.
